Terms of Service

1. Agreement. These terms apply to the website luxthemes.net and to products and services from Luxthemes (“Luxthemes”). By buying or using them you agree to these terms.

2. Licences. Our WordPress themes and plugins are licensed under the GNU General Public License (GPL) version 2 or later, like WordPress itself. Your purchase gives you a licence key that unlocks updates, support and any premium services for the plan and number of sites you bought, for the licence term. The GPL governs the software code; your key and our support are personal to you and may not be shared or resold.

3. Using our products. You may use them on the number of sites in your plan, including client sites where your plan allows. You are responsible for your sites, their content, keeping WordPress and plugins updated, backups, and complying with laws that apply to your sites (including privacy and consumer law).

4. Payments and renewals. Prices are shown in USD and include or exclude taxes as stated at checkout. Licences renew automatically each year unless you cancel before the renewal date. If a licence expires, the software keeps working but updates and support stop.

5. Refunds.We offer a full refund within 7 days of purchase if the product does not work as described and we cannot fix the problem. Where consumer law gives you further rights, those rights apply.

6. Support. Support covers help using our products as documented and fixing bugs. It does not include custom development, third-party plugins or hosting problems. We aim to reply within two working days.

7. Custom projects. Design and development work is covered by a separate proposal or agreement, which takes priority over these terms where they differ.

8. Acceptable use. Don’t use our products or website for anything illegal, to infringe others’ rights, to send spam, or to attack or overload our systems.

9. Intellectual property. The Luxthemes name, logo, website, documentation and design assets (outside the GPL-licensed code) belong to us. Images and demo content shown in previews may not be included or licensed for reuse unless we say so.

10. Warranty. We work hard to make our products reliable, but they are provided “as is” without warranties beyond those required by law.

11. Liability. To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits or data), and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

12. Changes and termination. We may update these terms, posting the new version here; changes don’t apply to purchases made before them. We may suspend licences used in breach of these terms.

13. Governing law. These terms are governed by the laws of NSW Australia, and disputes go to its courts, unless your local consumer law says otherwise.
